a relative or guardian of your child or step-child
is a relative or guardian or the live-in partner (or spouse) of your child or step-child
should be in a community organization

Carry out a Family Balance Test

The family balance test is to measure the Parent visa applicant’s family links to Australia. Moreover, the test determines the extent of the parent’s links to their children or stepchildren in Australia. Also, it helps to ensure that only those who have close ties to Australia can get eligible for a Parent visa.

However, the balance of family test is successful if the parent meets the following-

you have more children living in Australia than anywhere else
if a minimum of half of your children lives permanently in Australia

Most importantly, the test cannot be waived, even in compelling or exceptional circumstances. That is to say, you need to pass the test to apply for a parent visa.

Also, your children cannot be there in the balance test if

they are not alive
registered by the United Nations High Commissioner for Refugees (UNHCR) as refugees and live in a camp operated by the UNHCR
they have been removed from their parents’ exclusive legal custody by adoption, court order, or operation of law
they live in a country where they suffer persecution or human rights abuse and can’t be reunited with their parents in another country

And, if you are the step children then you are not counted if-

your former partner’s child who is under 18 years of age and with whom you have guardianship, custody or a parenting order in force under the Family Law Act 1975
born from polygamous or concurrent relationships are not counted in the balance of family test

Visa subclasses for parent migration to Australia

A parent category visa can allow you to either be a temporary resident in Australia for up to 10 years or an Australian permanent resident.

103 – Parent visa

143 – Contributory Parent visa

It is the best Australian visa to sponsor your parents which enables them to come and stay in Australia. Also, it provides them many options where they can live, study and work in the island continent permanently.

173 – Contributory Parent (Temporary) visa

It allows the applicant to live in Australia for two years. But, most importantly, this visa cannot be extended or renewed.

Above all, the 870 visa does not require meeting the family balance test.

804 – Aged Parent visa

864 – Contributory Aged Parent visa

884 – Contributory Aged Parent (Temporary) visa
