Traveling to a foreign country is a thrilling and exciting pursuit. You get to experience a new way of life. The most promising part about such a venture is the opportunity extended by your host country regarding permanent stays. In Australia, one can apply for a visa (both temporary and permanent) if an Australian permanent resident or citizen nominates them, or a New Zealand citizen who has obtained visa eligibility nominates them. The Relative Visa is one such visa that allows citizens of foreign countries to extend their stay in Australia through a legal framework.

Carer Visa – 116
The Carer Visa (subclasses 116 and 836) applies to essential caregivers of relatives who cannot obtain the care and help they need from other relatives or health care and welfare system or community services in Australia and have one of the following conditions. They have a long-term medical condition that prevents them from performing everyday tasks and needs practical assistance in caring for a family member suffering from a medical condition.
This visa allows you to stay in Australia indefinitely if your relative is an Australian citizen, Australian permanent resident, or qualified New Zealand citizen living in Australia. Additionally, you must be the applicant’s relative who requires treatment (for themselves or a family member) or the applicant’s spouse or partner who lives in the same house as the relative in Australia. Applicants for subclass 116 must be outside of Australia when applying and when the visa is issued.
Carer visa – 836
Unlike Carer Visa- 116, applicants for subclass 836 must be in Australia when they apply for a visa. The requirements and benefits for subclass 836 are similar to the visas above. However, it would help if you took note of the following. You must stay in Australia during the period of care extended to a relative with a long-term medical condition or assistance extended to a relative caring for a family member with medical conditions. You must be genuinely willing and capable of caring for or assisting your relative in Australia, or you and all dependent family members must meet health and character requirements when applying for a visa. With the visa, you can reside in Australia and apply for Australian citizenship after meeting eligibility requirements.
Orphan Relative visa – 117
This visa is for orphans who are unable to provide for themselves after the death of their parents. Any relative willing to take care of them can do so after applying for the Orphan Relative visa. With this visa, the child can shift to Australia as a permanent resident, study, and access Medicare. If eligible, apply for Australian citizenship. For this, the child must be under 18, single, and without a parent to look after them. They should have a settled Australian citizen, qualified New Zealand citizen, or Australian permanent resident and reside outside Australia when they apply, and the decision occurs.
Remaining Relative visa – 115
It is a permanent resident visa intended for those who are the only person remaining in their home country after their close relatives have moved to Australia. The applicant must be outside of Australia when filing the visa application and when the visa is issued. With this visa, you can reside in Australia as a permanent citizen, apply for Australian citizenship as a permanent citizen, and for the next five years, once the agency issues the visa, you can leave and re-enter Australia regularly (once you complete five years, you need to apply for another visa to return to Australia).
Aged dependent relative visa – 838
The aged dependent relative visa (Subclass 838 visa) is an onshore visa that allows the applicant(s) to be in Australia at the time of application and visa approval. Allows an older parent of an Australian citizen, permanent resident, or qualified New Zealand citizen to live permanently in Australia if they are financially dependent on them and meet the age criteria. The benefits are the same as any permanent visa subclasses. Browse through the subclasses above for more details.
It is pertinent for you to be very vigilant about the entire application process not to commit any error. It is also possible that your application may take longer to process if you fail to fill it out correctly or do not include all of the documents asked by the respective office.
